Surgical Error Lawsuits

Any surgery carries some inherent risks, and a good outcome cannot be guaranteed. This however, does not excuse medical negligence and wrongdoing. Preventable surgical errors, too often end in the unnecessary death of a patient or in permanent disability including the loss of organs or limbs.

Common surgical errors

Surgical errors can be catastrophic. These errors include:

· Wrong site surgery

· Nicking or cutting of nerves, organs, arteries, or muscle which should not have been involved in the surgery

· Leaving items, such as gauze, clamps or sponges, inside patient after surgery

· Failure to consider patient’s history when choosing to perform a procedure

· Inadequate sanitation

Surgical error injuries

Surgical errors can result in injuries far beyond any anticipated possible outcome. A patient going in for a routine “day surgery” can come out missing organs that should never have been removed, wind up in a coma, or die, due to surgical mistakes. Common injuries caused by surgical errors include:

· Infection

· Mild to severe pain

· Spinal cord injury

· Paralysis

· Need for subsequent surgery

· Loss of limb or organ

· Brain injury

· Birth defects

· Coma

· Extended recovery time

· Permanent disability

· Death

Wrong site surgery

Wrong site surgery is surgery performed on the wrong part of the body. This creates a very complicated problem. It means that the part of your body which should have been operated on was not, meaning that you will need another surgery. It can also mean the loss of a healthy organ or limb. Common types of wrong site surgery include:

· Wrong organ removed

· Wrong limb amputated

· Surgery on the wrong side of the body

· Surgery on the wrong vertebral level of the spine

· Surgery on the correct site/wrong level or area (such as surgery on the correct hand, but the wrong finger)

· Surgery on the wrong patient – can result in reversed procedures where two patients receive the wrong surgery

Inadequate sanitation and the use of dirty instruments

We think of the operating room as a sterile environment, and it should be, but not all operating rooms are well maintained. Failure to follow proper sanitation procedures can lead to the spread of infection from one patient to the next, resulting in serious, life-threatening injuries and a very painful, prolonged recovery time.

Leaving items inside the patient

Items such as sponges, gauze, and even surgical instrument are sometimes left inside of patients, causing infections and other injuries and often requiring additional surgery to remove the items. This is typically the result of failure to follow procedures which involve counting every item used in the surgery and making sure that everything is accounted for before the patient is closed.
